Reforma protestante: fundamentos para o estado constitucional

Abstract

This work analyzed the historical context of the Protestant Reformation, an event that took place during the sixteenth and seventeenth centuries, as a background and determining factor for the formation of the modern world, besides having an important influence on the political-juridical aspect. Through this analysis, using various renowned theorists in the area of History and Law, the objective is to understand the arguments of this period, the historical moment that potentially consecrated itself by the conquest of the right freedom as a right to freedom of conscience and expression. It is a bibliographical research, qualitative approach and historical analysis of its object. The material studied was composed of the different theoretical contributions available on the present theme. A careful and systematic reading was carried out, resulting in a set of activities oriented and planned aiming to answer the problem in focus. The systemic studies provided the basis for the conclusions and possible reach of the research objectives. The theoretical scheme developed in this work is based on the tradition of German sociology, in the sense that social facts can not be dissociated from the motives that determine the action of the subjects, bringing as reference the authors Max Weber and Nobert Elias. It was concluded by affirming the importance of Christianity in the construction of the modern world with regard to the political-juridical aspect and its permanent relevance to the present day, contributing to the preservation of such institutions as are dear to the human being, freedom, among other Rights said as fundamental to be addressed.
