A exclusão do(a) genitor(a) do registro civil em virtude do abandono afetivo

Abstract

This study deals with the possibility of exclusion of the parent from the civil registry due to affective abandonment, which becomes important because, as affection has become the center of family relationships, it is also necessary to discuss about absence of affectivity in these relationships and their consequences. The work methodology has a theoretical and qualitative nature, with a deductive approach method, using primary and secondary sources (legal, bibliographic and jurisprudential) with the objective to analyze the current panorama of Family Law from the principles applicable to family relations. Also, the importance of jurisprudence in protecting individuals' rights and guarantees in the family sphere not recognized by the legislation was emphasized. Achieved these objectives, it was possible to verify the relevance in attributing to the absence of affection the same importance that occurs to him in the configuration of bonds between parents and children, legitimizing the seriousness that is affective abandonment and allowing the abandoned child which has already reached the age of majority to completely disconstitute any legal relationship with the absentee parent.
