Novos aspectos da regularização fundiária urbana no Piauí: um estudo acerca da usucapião no âmbito do Programa Regularizar

Abstract

Urban land regularization is an essential tool for promoting citizenship, social justice and the right to decent housing, especially in contexts historically marked by territorial and socio-economic exclusion. The problem involved in the research consisted of examining the importance of accessibility and reducing bureaucracy in land claims, as a means of making the right to housing more tangible and tangible, making property fulfill its social function. Given this scenario, the aim of this work was to analyze the new aspects of urban land regularization in Piauí, with special attention to the application of the usucaption institute within the scope of the Regularize Program, instituted by the Court of Justice of the state of Piauí, through Joint Provision No. 89/2023. The methodology used was qualitative and quantitative, taking an interdisciplinary approach to the subject, using bibliographical and documentary research, not only in the legal field, but also historical and sociological research, as well as analyzing the data obtained from the III Justice 4.0 Center and the CERURBPro and CERURBJus systems. The results showed that usucapião, traditionally linked to the lengthy and difficult judicial process, has been given a new meaning in the context of land regularization promoted by the Piauí Judiciary. By adopting a faster, more accessible and less bureaucratic procedure, the Regularize Program strengthens the recognition of qualified ownership and promotes the titling of properties occupied by families in situations of land irregularity. It was concluded that Reurb, by integrating legal, social, urban and environmental dimensions, is consolidated as a fundamental public policy for the dignity of the human person, assuming a central role in the construction of fairer and more inclusive cities.
